I killed my mother.

In South Korea, year 2011, a highschool student killed his mother and lived with her corpse in the house for 8 months. His motive for murder was to avoid the extreme violence of his mother. Violence continued until dawn, each time his grades dropped. It repeated for 5 years. The film is based on this case. In case of persistent abuse from the mother, when the child kills her in order to avoid being killed, is the child guilty? If so, who has the right to accuse the child, under which crime?
